Terms of Service - Stay Steady

These Terms of Service (“Terms”) govern your use of Stay Steady (“the App”), an iOS application developed and operated by Data Consulting Services, a company registered in Belgium (“we”, “us”, “our”).

By downloading, installing, or using Stay Steady, you agree to these Terms. If you do not agree, do not use the App.

1. The App

Stay Steady is a personal budgeting and expense-tracking application for iOS. It is designed for individuals who want to track their own spending and savings on their personal device. The App is not a financial advisor, accountant, tax advisor, or regulated payment institution.

Stay Steady is free to download and use. All features — manual transaction entry, file import (CSV, PDF, OFX, CODA, MT940), on-device categorization, budgets, savings goals, and receipt scanning — are available offline and at no cost. The App does not connect to your bank.

2. Eligibility

You may use Stay Steady if:

  • You are at least 13 years old (or the minimum digital-consent age in your country, whichever is higher);
  • You are using the App for personal, non-commercial purposes;
  • You comply with these Terms and applicable law.

Stay Steady is intended for residents of countries where it is offered on the App Store. We make no warranty that the App is suitable for use in any particular jurisdiction.

3. Your Account

Account creation is optional. You can use the full local feature set of Stay Steady without an account.

If you choose to sign in:

  • You authenticate via Sign in with Apple. You are responsible for safeguarding your Apple ID credentials.
  • You agree that the information you provide (e.g. email, if shared via Apple) is accurate.
  • You may delete your account at any time via Settings → Delete Account, or by emailing us. Deletion removes your authentication record and any server-side machine-learning feedback contributions linked to you. Local data on your device is independent and not affected by account deletion.

You are responsible for all activity that takes place under your account.

4. Price

Stay Steady is free to download and use. There are no subscriptions, no in-app purchases, and no advertisements. All features are available from the moment you install the App.

We reserve the right to introduce paid features or services in the future, but any such change would only apply going forward and would never restrict access to data or features you already use today. If we ever introduce paid features, these Terms will be updated and you will be notified before any charge can occur.

5. How Transactions Get Into the App

Stay Steady does not connect to your bank. You bring transactions into the App yourself in one of three ways:

  • File import — export a statement file (CSV, PDF, OFX, CODA, or MT940) from your online banking portal and import it into the App. The App parses the file on-device.
  • Receipt scanning — photograph a paper receipt; on-device OCR extracts merchant, amount, and date.
  • Manual entry — type a transaction in directly.

The App has no third-party PSD2 / Open Banking integration and never holds your bank credentials. You are responsible for ensuring you are authorized to access any statement you import.

6. Acceptable Use

You agree that you will not:

  • Use the App in violation of any law or regulation;
  • Reverse-engineer, decompile, or disassemble the App, except to the extent allowed by mandatory applicable law;
  • Use the App to track or monitor accounts that do not belong to you or that you are not authorized to access;
  • Attempt to gain unauthorized access to our backend services, edge functions, or other users’ data;
  • Submit false, misleading, or harmful content via in-app feedback channels (e.g., category corrections, bank requests);
  • Use automated tools (bots, scrapers) to interact with the App or our backend services;
  • Resell, rent, lease, or sublicense the App.

We may suspend or terminate your access if we believe you have violated these terms.

7. Your Content and Data

What You Own

You retain all rights to the data you create or import in the App (transactions, budgets, goals, categories, notes, receipts). We do not claim ownership.

What You Allow Us To Do

When you use the App, you grant us a limited, non-exclusive, revocable license to:

  • Process the data only as described in our Privacy Policy and only for the purpose of providing the features you have enabled;
  • Use anonymized, aggregated machine-learning feedback you explicitly consent to share, to improve our categorization model;
  • Display, transmit, and back up your data to optional services (iCloud, ML feedback, analytics, crash reporting) only if you have enabled them.

We do not sell your data, share it with advertisers, or use it for marketing.

Backups Are Your Responsibility

We strongly recommend enabling iCloud sync if you store significant data in Stay Steady. Local data lives on your device. If you lose, reset, or sell your device without backing up, that data may be lost. We are not responsible for data loss due to device failure, OS reset, accidental deletion, or failure to enable backups.

8. Third-Party Services

Stay Steady relies on a small set of carefully selected processors (Apple, Supabase, Sentry, Aptabase). Their roles, regions, and data handling are described in our Privacy Policy.

These third parties operate under their own terms of service and privacy policies. We are not responsible for their actions, but we have selected them based on GDPR compliance, EU data residency where applicable, and signed Data Processing Agreements.

9. Not Financial Advice

Stay Steady is a tracking and budgeting tool, not a financial advisor.

  • Categorizations, suggestions, anomaly alerts, savings nudges, and “financial health” scores are produced by software heuristics and machine-learning models. They may be wrong, incomplete, or outdated.
  • The App is not a substitute for advice from a qualified financial advisor, accountant, tax advisor, or licensed professional.
  • Any decisions you make based on information from the App are made at your own risk.

10. Disclaimers

To the maximum extent permitted by applicable law:

  • The App is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement.
  • We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.
  • We do not warrant that statement files imported into the App will be parsed completely or accurately — bank statement formats change and OCR results may contain errors. Always verify imported data against your official bank records.
  • We do not warrant that any specific savings or financial outcome will result from using the App.

These disclaimers do not exclude or limit any rights you have under mandatory consumer-protection law in your country (including EU consumer law), where such law applies.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Stay Steady is free, so the amount you have paid us is zero. To the extent any liability arises, our total cumulative liability to you, for any cause whatsoever and regardless of the form of the action, will not exceed fifty euros (€50).
  • We will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to loss of profits, loss of data, business interruption, or loss of goodwill.

Nothing in these Terms limits liability that cannot be limited under applicable law (for example, liability for fraud, gross negligence, or death and personal injury caused by negligence). EU consumer-protection rights remain unaffected.

12. Termination

You may stop using Stay Steady at any time by:

  • Deleting the App from your device;
  • Optionally, deleting your account (Settings → Delete Account).

We may suspend or terminate your access if you breach these Terms, or if continuing to provide the App becomes legally or commercially unviable. We will use reasonable efforts to notify you in advance unless doing so would be illegal or unsafe.

Upon termination:

  • Your right to use the App ends.
  • Any local data on your device remains on your device until you delete it.
  • Account-related server data is deleted in accordance with our Privacy Policy.

Sections of these Terms that by their nature should survive termination (e.g. ownership, disclaimers, limitation of liability, governing law) will survive.

13. Changes to These Terms

We may update these Terms from time to time. When we do:

  • We will update the “Last Updated” date at the top of this page.
  • For material changes (e.g. new fees if ever introduced, significantly expanded responsibilities for you), we will surface an in-app notice on next launch and give you a reasonable opportunity to review the changes before they take effect.

Continued use of the App after changes take effect constitutes acceptance of the revised Terms. If you do not agree, you may stop using the App.

14. Governing Law and Disputes

These Terms are governed by the laws of Belgium, without regard to its conflict-of-laws rules.

If you are a consumer resident in the European Union, you also benefit from any mandatory provisions of consumer-protection law in the EU member state where you reside, and disputes may be brought before the courts of that state to the extent required by law.

The European Commission provides an Online Dispute Resolution platform which you may use for disputes related to online purchases.

For all other users, any dispute arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the competent courts of Brussels, Belgium.

15. Apple App Store Terms

Stay Steady is distributed through the Apple App Store. In addition to these Terms, your use of the App is subject to the Apple Media Services Terms and Conditions (available at apple.com/legal/internet-services/itunes/).

You acknowledge that:

  • These Terms are between you and Data Consulting Services, not between you and Apple.
  • Apple has no obligation to provide maintenance or support for the App.
  • In case of any failure of the App to conform to applicable warranty, you may notify Apple, and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation.
  • Data Consulting Services is solely responsible for addressing any claims relating to the App.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

16. Entire Agreement

These Terms, together with our Privacy Policy and Apple’s Media Services Terms, constitute the entire agreement between you and Data Consulting Services regarding Stay Steady, and supersede any prior agreements between us regarding the App.

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
